OP can contest the ticket and show the phone history as proof. If the number is 911 they'll drop it. If it's something else I'm not sure.

Wtf is wrong with you people? He's being a "jerk" and a "snitch" for trying to report a dangerous driver that could have caused a car accident killing a LITTLE KID? Drunk driving isn't a joke, I know people who have died to it -.-. Sure, it's not certain that the guy was drunk, but whatever his problem was, if he was swerving all over the road he should have got pulled over. The police officer is an idiot for not pulling the other guy over instead, unless another cop pulled him over. As to OP, sorry man, that sucks =(.

(see V C Section 23123 Hand Held Wireless Telephone Prohibited Use) There is a little detail that applies here: (c) This section does not apply to a person using a wireless telephone for emergency purposes, including, but not limited to, an emergency call to a law enforcement agency, health care provider, fire department, or other emergency services agency or entity.

It probably wasn't a DUII driver...it was probably just a person using their cell phone, just like you. I see it all the time, especially with texters.
