Today, I thought that I had finally sold the car I've been trying to sell for two years. I had the money in my hand and had given over the title. As the "new" owner went to drive it away, the car wouldn't start. I had to give the money back. FML

It was my car and I did drive it to meet them, they test drove the car, turned it off as we negotiated and then when they went to start it again, it didn't start. Apparently, the fuel pump went out in it. Also, I gave the money back because I would have felt like a jerk for not doing that. And I wish that this was fake...then I wouldn't be out a couple thousand dollars right now.

depending on what type of car it is and how old, a fuel pump is only about $150, give or take some. My boyfriends cost $120 and my dad's cost $200. Tell them you will have it fixed and then sell it to them.

Who would buy a car without test driving it first? Your buyer sounds like a dolt.

Oh, and submitter, you mis-used the quotes. This was not the "new" owner -- this was the new owner. I could *almost* understand saying the new "owner" since you got suckered into refunding.

Oh that sucks!!! Next time make sure everyting is Kosher BEFORE any buyers come over...

Sorry chief, feelings shouldn't factor in, should have shrugged said buyer beware and walked away. A year or two ago I was selling a stove, and as he loaded it into his truck it fell and the front glass shattered, he wanted his money back I told him to **** off, and that's how you sell shit

for vehicles, most states have "lemon laws" and had op acted the way got described they would have not only had to give the money back but pay legal fees after having to go to court. even at a prestigious dealership, if you sign and then it won't start to leave the lot, is a lemon. that's not the same as someone accidentally damaging their purchase within minutes of buying line you described. like yeah if they had crashed it two seconds after buying, OK.

Who waits 2 years to sell a car?? You lose the car's 2 year's value AND 2 years of car insurance.

you can take it off your insurance plan if you don't drive it, and maybe they had been trying to sell it, but nobody was buying until this point

You'd probably make more money selling individual parts.

Not all of us own chop shops, BigDawg.

You're stupid. The transaction was complete, it was his, and you were not obligated to take it back. Would it make you a bit of a jerk to keep the money? Yeah. But it would have been within your contractual rights.

Money in hand implies the title was signed over. Even if it was not, cash in hand makes it very hard to rescind, especially without a good reason -- and "car is 'as is' and I do not like it" is not a good reason.

No. The buyer cannot rescind after the contract has been fully performed by both parties. Once the car and title is handed over and the seller has the money, the contract is done. The buyer is shit out of luck, as used cars from private sellers don't come with warranties.

Having morals isn't a bad thing. It sucks that this happened but generally, two people and a used car sold as is is just what it is. I can't think of one person buying a car who a few grand who's gonna hire a lawyer. It's a fuel pump. Easy, cheap fix. OP should have offered them a few hundred off to get it fixed and been done with it.

there are lemon laws in most states thar would've required OP to give a refund for the car since it didn't start

Okay, here is what you do. Next time, before selling the car, make sure it works.
