Today, my colon got perforated during a routine colonoscopy. Apparently, it's a rare complication and I have no legal recourse. So now I'll need to use a colostomy bag for the next 6 months until I can get surgery to fix their mistake. FML

They better pay for the procedure since it's their mistake. Sorry to hear that op, but least it's only 6 months and not the rest of your life.

You need to tear that doctor a new asshole! Just like he did to you.

Definitely don't take the hospital's word you have no legal recourse. Consult a lawyer.

I am honestly kind of confused by this one. IF it's a rare complication then the mistake was not saying "Hey in very rare circumstances perforation of the colon can occur" in which case if they didn't tell you that and it would have stopped you from having the procedure then speak to a lawyer because not knowing all of the risks absolutely allows you legal recourse. If they gave you a document to read with all of the risks even the rare ones though didn't tell you the rare ones. Then no mistake was made and that's on you. If it's not a rare complication and isn't something that should be able to happen unless they **** up the colonoscopy then again you have legal recourse. So yeah basically the only way you have no legal recourse is if the risk was disclosed to you written or spoken and you went ahead with the procedure anyway.

It's shut like this that makes me not want to go for mine . . I'm ******* terrified

My brother has had many colonoscopies and endoscopes, he says they're not too bad.

I hope you didn't take the hospitals word for it and if you did, you should definitely contact your own lawyer to double check whether or not you have a case.

They should at least not make you pay to fix it

If they didn't tell you it could happen get a lawyer if they did sadly you assumed the risk

I can imagine even though it's rare you should be compensated for the damages. I would suggest calling as many malpractice lawyers until one take your case then sue all involved (doctors, nurses, techs, facility it was held in, ect.) for damages and mental anguish. Also go as far back as you can in the history of the doctor/facility to see of he's ever been sued for malpractice before and why could help legally. Sounds like you do have a case just you found a lawyer who doesn't A) want to take on a more difficult case due to lack of skill or B) doesn't want to because it's not guaranteed to be a quick profit and they're just lazy and in it for the money. Rarity of the injury doesn't make it any less valid of a case.
