Today, my colon got perforated during a routine colonoscopy. Apparently, it's a rare complication and I have no legal recourse. So now I'll need to use a colostomy bag for the next 6 months until I can get surgery to fix their mistake. FML

They better pay for the procedure since it's their mistake. Sorry to hear that op, but least it's only 6 months and not the rest of your life.

Sorry that this happened to you! I hope you feel better soon! I work in medical field and would like to give my two cents. No procedure is routine in medical world, to consumer it may seem that these procedures are routine since they carry very low percentage of risk. When you choose to drive car, you accept the fact that somebody can kill you or you can kill yourself by driving recklessly. everything we do in life has its own risks. No physician wants to make hole in their patient's colon. But putting a scope in your colon, there is a potential you can get colon tear, its very rare but it can happen. It just bad luck. I am not trying to protect physician, sure if you think your physician is negligent, you should seek legal help. just trying to tell that there is no routine procedure in medicine.

Unless you signed something that says "if I accidentally tear your asshole, you promise not to sue me" I would seek a lawyer. That's a long six months dragging around a bag of poop, OP

You actually might have legal recourse. Get ALL the medical records (procedure note, anesthesia notes, nurse notes, labs, etc) and have malpractice attorney review them to see if you have a case.

Here in the USA, you are usually stuck maxing out your insurance deductible when a colonoscopy goes wrong - so if you are on a high deductible plan, you are screwed. Especially since the corrective procedure may be considered "not required" and you get to pay for the whole thing out-of-pocket. You can also be fired missing work, needing anything special, etc. So its not inconsequential

You definitely can and should do something about it. I am the Director of Quality for a health plan. OP, you should file a potential quality issue with the health plan, get copies of your records (including the release of info form your just signed before your procedure), and have some review them before you decide not to pursue legal action. For all you know the doctor sliced your bowel because he was head-banging to Metallica when he was performing surgery.
