your HR department should know what is legal or not, if the guy is making the workplace unbearable for you specifically, then he can't just have Aspergers and/or blame that condition

You bloody idiot! Aspergers people can talk and reason like normal human beings! We are not vegetables! All it is is social awkwardness, finding it harder to listen, slight learning difficulty and a few mood swings. It does not excuse the guys behavior at all, but do your goddam research before opening your fat gob!
um no disrespect but to clarify it's not "Assburgers" it's Aspergers which is a social disorder and a form of autism which is a real thing... it sucks you have to deal with that though just be aware
Seriously!? It's aspergers syndrome. Not "assburgers" I'm not saying this guy has it, but coming from someone who has it, you should all be ashamed of yourselves!
I have Aspergers (I call it "assburgers" to special snowflakes who pretend to have it) and you do get angry and emotional more often then normal people, but we are humans who know right from wrong, and if someone uses their "assbugers" to act like a complete jerk, they are giving us all a bad name and disgust me.

If that's a case he should have the guy medically evaluated. Or at least talk to the guy and try and make it so you don't sue him for a hostile work environment.
