Landlords gonna landlord

By goingtobeevicted - 25/04/2013 06:28 - United Kingdom - London

Today, my new landlord and lettings agent made an illegal entry into my house. Unfortunately, at the time my boyfriend was buck naked, smoking a joint on the sofa, surrounded by the cats we aren't supposed to have. FML

It doesn't matter how many illegal things he was doing. Anything seen or any evidence was taken illegally and you cannot be prosecuted through it.

I bet if he passes that joint everything will be fine!

Wrong place at the wrong time

I had a landlord like that once. She would just come and go as she pleased without warning. You could be taking a shower and she would walk right in and "inspect" the house and walk right into the bathroom and try to talk about the house and other business. Should sue...

I'm not so sure about the UK but here in the U.S. you wouldn't be evicted since that was seen via an illegal entry. Since they wouldn't have seen that otherwise, and it wasn't apparently obvious, you'd get away scot-free because of some awkward technicality, essentially you can only be busted for the stuff they gathered legally. Then again, totally different country. Not the same, probably doesn't apply there in the UK

UK law allows a landlord to open the door, bit not enter, to call to a tenant, which may have let him see or smell the cats and dope. Or the stoned boyfriend may have yelled "come in" when they knocked, fml shows us people yell things they shouldn't out of habit with alarming frequency.

That law only stands for agents of the law, not homeowners. If I break into your home and find a bloody knife, I can turn it in to the police who can then use it to convict you. Because /they/ weren't responsible for the 'illegal search/seizure'.

Sounds like an episode of family guy... Except you're not supposed to do this in real life. You both deserve it 110%. Thanks for the laugh though. Lol :)

PMSL thanks for the visual! sorry OP but you sound like you have my kind of luck :| I can never lie or get away with anything either LOL

You could sue for unlawful entry and win.

Since they entered illegally, they can't do anything about it! You might want to consider rehoming the cats!

I bet you can still sue them for your money.

Is it written in your lease that he can enter at will without prior notice? If it is, it's not illegal entry.
