I am terribly sorry about the situation you are in. Sadly I do not know the Legal Situation in NZ, how ever I dont think its right. Some people just should not be a boss. As many have already said, make sure you save the TXT messages and dont be affraid to fight him on it. Best of luck to you, and a good recovery from your surgery.

I think it sounds tacky to have to text a boss..most issues with managers are done over the phone last time i checked
If the manager gave the cell phone number it likely meant he would prefer to be informed through any method, and texting has become an accepted method of communication between workers and their employers. Even if this particular boss just used it to be a dick.

When I read FML's like these I always think about how people would react if someone else told them. For example if your SO had phoned your boss and explained you had to have surgery. Maybe they'd actually take it serious because you aren't even able to phone them.
