Today, my boss decided that we no longer have to clock out for cigarette breaks, but we do for toilet breaks. I'm the only non-smoker on my floor, and I'm getting penalised for it. FML

Well, smokers tend to socialize, and the talk tends to be about work, so maybe the boss has a good plan going. Outdoor brain storming sessions.

Pretend you're a smoker and take breaks then use that break to use the restroom without being noticed.

can you talk to hr about it or something or talk to him? that seems a little extreme to clock out to use the bathroom

Unless you're the only person who goes to the bathroom, this really isn't a penalty for you

except it is because the smokers can go in their smoke break.

But then they'd be violating the company policy to punch out to go to the bathroom.

In the US, you can't be forced to clock out for any break less than 15 minutes. It's also considered discrimination to offer breaks to smokers but prevent non smokers from taking similar breaks. Document the policy and contact HR.

it's not illegal discrimination unless smoker suddenly because a race or religion and nobody bothered to tell me about it.

it is illegal as it is favouring one group over another for a trivial reason. smoke breaks are only legal because us non smokers can go out too if you want to die of smoke inhalation.

Discrimination isn't limited to just race and/or religion.
