Today, my boss decided that we no longer have to clock out for cigarette breaks, but we do for toilet breaks. I'm the only non-smoker on my floor, and I'm getting penalised for it. FML

Yeah...I don't think that's legal. Why in the world would you have to clock out to do either of those things? Some places give you 30-minute breaks that you have to clock out for, during which you can smoke or do whatever, but that's considered a lunch break. I've never heard of having to clock out to go to the bathroom. Who thought of that lame idea? I realize this is the UK so I don't know the policies over there, but I've still never heard of such a thing. I'd take it up with the labor board.

I'm not sure about in the UK but in Canada that is completely illegal. I'd look into that

Easy. Take a "smoke" break, use bathroom on way back from said break. Or as your smoke break. Makes no sense at all to me to dock someone for bathroom break but not smoke break. Not going to the bathroom can cause urinary tract infections, bowel blockage, and even death if attempted over a long enough period of time. Not going out on a smoke break can make you a little edgy, but could also be good for you (reduced exposure to carcinogens, practice at delayed gratification).

That's SO unfair. I'm a nonsmoker too. And all the smokers are always running outside, while I stay in and work.

As a smoker, your boss is an ass! Come on, dude. 99.9% of the time, a smoke break is going to be waaaaaay longer!

It should be the other way around. Clock out for smoke breaks but not bathroom breaks.
