it is her fault... the excuse that you should keep a safe distance from the car infront of you doesnt always work.. how far back do you have to drive from the car infront of you to avoid someone randomly slamming the brakes on the highway.. i mean if everyone is just driving on the highway in the flow of traffic you are not really going to the expect that one random person to slam his or her brakes like an idiot and put everyone else's life in danger.... common sense tells you that you dont slam the brakes when you see a bird hit your windshield... i have been startled and shocked by rocks flying into my windshield while driving on the highway and my first reaction was to look around and make sure my windshield was ok not to slam the breaks... if op loses all common sense when situations like this occur while driving then its obvious she shouldn't be driving...
A traffic jam on the highway that you can't see would be another case where someone might "randomly" slam on their brakes. Are you suggesting that that would be the driver's fault also, not the fault of the person who did the rear-ending? There are many reasons why someone may need to slam on the brakes while driving. Law says that fault goes to the person following because they are supposed to be prepared for emergency braking. And if you are inspecting your windshield while driving, maybe YOU are the one who should not be driving, kenny. Don't chastise OP when you clearly have driving issues of your own.
what the hell are you talking about idiot.... you look out your windshield when you drive thats how you see the road retard.. i didnt say i take off my seatbelt and get up and inspect the windshield inch by inch to see if its ok... while continuing to drive and not slamming the breaks and almost killing other people on the road.. you look around to see if there are any major cracks on your windshield.. make sense?
Everybody knows it is a driver's responsibility to leave enough space between them and the car in front in case the person in front slams on their brakes in an emergency. If you said "well everyone was just driving on the highway in the flow of traffic, I wasn't really going to the expect that one random person to slam on his brakes, was I?" in a court, the judge would laugh you out of the courtroom. I would far prefer someone like the OP on the roads than someone like you who obviously does not know the rules and cannot take responsibility for the control of his own car.

I totally agree with LilaBear, it is your responsibility to place a great enough distance between yourself and the car in front of you, so that if you need to come to an emergency stop, you can do so. As to "how far back do you have to drive from the car infront of you to avoid someone randomly slamming the brakes on the highway," most places that allow someone to drive have some sort of driving instruction book with basic suggestions as to the distance you should keep between yourself and the car in front of you, based upon driving location, speed, and distance. Most people have enough common sense to estimate a good distance, but clearly you don't, I suggest you use the book. As for your ignorant comment about rocks falling on your car, if a rock large enough to shatter your windshield hit your car, would your superhuman instincts prevent you from hitting the breaks, as you, with eyes wide open check for cracks in the glass as it falls into your eyes? Because I'm pretty sure you'd hit your breaks, and by your logic when the Semi behind you plows into your car and kills you, he can just go to court and be lick... uhhh... why should I expect someone to hit their breaks on the highway! That never happens. There's no way I could estimate a safe stopping distance. Inconceivable.
