Today, during a class, I noticed some racist statements and symbols on a table. While erasing them, I bent down to pick up my dropped pencil. I look back up to see a teacher, and got a suspension. FML

Something similar happened to me in elementary school. They didn't believe me because they saw me doing something in the direction of the writing (using the eraser on the bottom of the pencil) but regardless I got into trouble. Luckily for me my mum is a psycho and yelled and went off at the principal :D

Wow you have a stupid teacher, does she even have proof you did that? if i were you i would take this to court and you could get proof by school cameras or just protest that you shouldn't be suspended. Racist symbols are in my school as well so i ignore them because it keeps me out of trouble and it is just better.

most schools have cameras in the hallways, cafeteria, and gym.

You say that as if the OP is stupid enough to just take the situation lying down! Of course he said "but I didn't do it, I was erasing it" - Unfortunately he was caught in a compromising position and the burden of proof is against him.

No, the burden of proof is on the person trying to prove something, not disprove something. The teacher has to prove that he DID write it. The student shouldn't have to prove that he DIDN'T write it, which is impossible since you can't prove a negative. Unless the teacher saw him write it, she has no right to suspend him.

That's not how it works in the school systems - The teacher caught him in a compromising position. fiddling with the desk [from far off and depending on how rigorously he was erasing the desk it may not have been obvious that he was using the eraser] - The teacher didn't first see him with his pencil on the floor, that's just when he noticed the teacher in front of him. . . This isn't the justice system and is simply a detention - Ya it sucks but had the student been so heavily concerned with the flavor of writing on the desk he should have brought it to the instructors attention. I'm not saying he deserved it but, really, there isn't much he can do other than continuously stick by his story.

If he was trying to hard to erase it, where are all the eraser leavings? There would be obvious evidence if he had actually been erasing. Of course, the teacher could just as easily say he chickened out after drawing it. If he really wanted to stay out of trouble, he would have told the teacher as soon as he saw the "racist statements and symbols." The fact that he obviously didn't looks kind of suspicious. Regardless, schools aren't a court of law and circumstantial evidence is all that is needed to write-up, suspend, or even expel a student.

Error correction: If he was trying *so* hard to erase it... Commenting from a phone is difficult sometimes. :-)
