You should be happy, with this you get to get rid of 2 pieces of garbage.
Just give it to him and ascend to PC gaming. You'll be getting rid of two horrible parts of your life.
Just push him out and change the locks. Don't give him your Xbox.
If your name is on the lease then you can kick him out. If his names on the lease then you have to leave if both your names are on the lease then then I if you will have to leave. With the exception of you having the apt before and you added home to the lease.
If he is on the lease and it's not just you paying to live there you have no right to kick him out before the lease is up. However, if it's all your money paying for the place, go for it. Just don't break any laws or lease rules. it'd be a stupid thing to do, and would leave a negative mark on your record. Good luck.
If he's on the lease, he's legally allowed to stay there. If he is not, he has squatting rights for usually around 30 days. Talk to the landlord (Again, if he isn't paying for the lease) and he can help you with paperwork. It sucks, but Squatting rights were made for this very reason. No one deserves to be given a day to move out. If you've been asking for a while, tough luck. Start now to push him out.
Don't do stuff for him (anymore). Don't answer him, don't talk to him and keep an eye out for your stuff. Leave hints for him about getting the **** out, if it's your apartment, or look for your own while you show him that shit like that is not okay. Contact you landlord if he is not on the lease have them change the lock while he's out and see if the landlord has a holding place so he store all your exes things until he get back with no key and have the police waiting only to keep the peace and escort him out.
Landlords cannot legally due that. It has to follow due process and he has to go through an eviction before locks can be changed or he has to move out first on his own.
