Why are you blaming the waitress? Show some responsibility for your own actions. Knowing that you have an alergic reaction to peanuts, you should make sure you understand which things contain peanut ingredients, and whatnot. Don't sue the restaurant because you were too stupid to check first. *Rolls eyes*
You mean by like, asking the waitress to check that what you want doesn't contain anything related to nuts? Yeah, they probably should have d- oh wait, they did. Unless you mean they should have psychicly discovered that she was wrong?
Did they? I'm not so sure. The guy who wrote this wasn't so specific as to whether or not he had made sure with the waitress herself before puchasing his meal. I don't suppose we can argue that. But since we don't know exactly what happened, I think what I said was fairly reasonable. I'm allergic to eggplant. So I've made sure I know what I'm ordering beforehand. This guy was allergic to peanuts, and apparently at some point, the waitress told him peanut oil didn't count. This guy should have known about his OWN allergy, whether or not peanut oil was safe or not. And if nothing else, if you have to ask if it's the right thing to eat, then don't.
I'm guessing that the person did these: 1. Asked if say, the Won-Ton Shrimp(I'm just gonna say that for the sake of not having to say "the thing they ordered.") had peanuts in it. 2. The waitress said "No." not knowing the peanut oil had peanuts in it (douchebag). 3. The person ate the food and had a reaction. 4. They were lying on the floor having a severe reaction waiting for an ambulance (or something like that) and said to the waitress "You said it didn't have peanuts!" 5. The waitress replys "It didn't!" 6. "Did it have peanut oil?" 7. "... Peanut oil doesn't count!"

This is unfortunate, and you definitely don't deserve it, but it never hurts to remember that it's all in the phrasing. Saying, "I am allergic" will go a long way towards your waitress making sure you don't have a reaction in the restaurant. Also, most people who are allergic to peanuts don't react to the oil, so make sure you emphasize that you do when you ask. A lot of Asian restaurants cut corners like that, I've found. For example, they'll say a dish is vegetarian even though it's been cooked with chicken broth. So it also never hurts to research the restaurant beforehand and see if people have had any problems with the ingredients. And lastly, many Asian cuisines involve the frequent use of peanuts, so it doesn't hurt to be aware that even if YOUR dish doesn't have peanuts, it may have been prepared in the same pan or using the same utensils as one that does. You'll be safer at a restaurant where not many dishes have peanuts.

I'm not saying it wouldn't be sad but the world is over populated so it's better to think of future generations for when the aliens land and attack us. So yeah, I'm thinking of the kids.
approximately 55% of people in the US have food allergies, and only a small portion know they are allergic to anything, most allergies are not transmitted genetically, so you could actually be wishing that you yourself would die as well for no apparent reason... oh and OP that really sucks peanut allergies are a real pain >.< thats partly why my parents didn't take me to China with them to see the olympics... some people just don't get it
What you're wishing by invoking natural selection is that no one with a food allergy will be able to reproduce. Since many of them have already done so, you're wishing that their children will drop dead or disappear. Also, food allergies are more common in developed countries than in the more densely overpopulated third world. But I wouldn't expect you to know or believe that if you don't understand that having more people around increases your personal chances of not being fed to those aliens.
Sorry but I have to say YDI on this one I mean if you have a peanut allergy you shouldn't just ask if it has peanuts in it, that kind of implies that you just don't like peanuts and most people wouldn't think to consider peanut oil when asked this question. You should have been more specific when asking about the ingredients.
It may have been that the OP actually did state that they were allergic, and the waitress told her that there were no peanuts in the dish...
