Today, I was fired from the restaurant I work at because I missed my shift. I missed it because I was in the hospital for food poisoning from the meal I ate at work last night. FML

if this person works at an "at will" employer, then he can't sue, and they can fire him for pretty much anything.

Agreed. Many states are "at will," so suing might be kind of hard. Make sure you read up on your state's labor laws before you call a lawyer!

You do have the right to report them to the Health Department, that can do more damage to them than you trying to sue them. Unfortunately most states have At Will Employment.

If you have a note from the hospital, your job can't legally fire you. You can file a wrongful termination lawsuit and they'll be in a lot of trouble for it.
