assuming you explain the story to him, and he refuses to believe you. There is two drips of beer in the can left, ur a dumba** for licking out the two drips that were left. Assuming he gives u the breathalyzer, 2 drips of beer is not enough to trigger .01. If he still MIP's u then take it to court and in ur defense say he didnt have sufficient evidence (which is obviously true).

1) Demand a meeting with your dean, or at least a representative ASAP. 2) When talking to somebody with an authority, first tell them that you picked up a littered can to throw it away, and second, tell them confidently that you haven't had a drink in months, and they can give you a sobriety test, as well as a urinalysis (urine test) to see if you have any traces of alcohol in the bloodstream from the past month or two. 3) When it comes up clear, ask him kindly if he would call up your parents real quick, so they know the real deal and don't ground you. If he won't do that, just call them and tell them the truth, that you got off since you were throwing it away. 4) If he doesn't believe you, file a lawsuit with the nearest plaintiff and take him (and the school) to court. Sue them for violating the constitutional right of "innocent until proven guilty", and explain he did not give you due process. The courts will be forced to rule in your favor. What is an MIP? I've never come across that acronym.
