I actually have asbergers ********
One of my best friend has Asperger's, and sometimes she really can totally misbehave. Once, she belittled my Sunday School teacher. When I confronted her about it, it turned out she had never considered that her words would hurt the teacher's feelings and immediately apologized. If he is really with AS Syndrome, maybe he just doesn't know. And if he doesn't, then he's just an ass.

Report it higher up. If there is no higher up go to a lawyer. Either way get it documented that he has done SOMETHING to you at some point and your boss had to talk with the other employee about it at least. Get that much, once that is done, you can sue the piss outta your boss for NOT firing him.
As someone with actual Aspergers this guy just needs to be fired. It is not an excuse for being a jerk and keeping him there without doing anything will make him think it is ok.
