While it does depend on where you live, it seems to me (and please do correct me if I'm wrong) that you KNEW PRIOR that their tree was structurally insufficient and thus KNEW PRIOR that it was a high fall risk. Simply put, because you decided to park your car under a tree that you already knew was likely to fall, you may be completely liable. So, definitely go talk to a lawyer... get at the very least a free 30-min consult. Also, if you haven't already, file a police report so it's on the record. Don't say anything more than that it was their tree and your car. That's all they need to know. Either way, FYL... but, next time, try not to park under a tree like that...
If the neighbors tree is right next to this persons drive way should they not park in their own drive way? You are wrong if you believe so. I have the right to park in my driveway and if my neighbors neglect their dead tree that is next to my driveway and it falls on my car that is parked in my driveway I will sue them.
Do you have insurance? if so, your ins may cover the damages and in some instances, the ins company will recover the money from your neighbor. There is always civil court and you don't have to have a lawyer... bettet yet, take em to judge Judy!

they are. if they knew that tree was trouble, they are liable. if the tree was in good condition and fell, it goes under comp on your auto
you can make their home owners insurance pay it cause it was a tree on their property which means they should of cut it down before it fell on your car or if you don't want to fight with them you can make a claim on your home owners insurance or your car insurance it's up to you but you got a few options. fyl your neighbors suck
I wonder if OP is from Louisiana. Trees fall so often here that there is a law that states the homeowner is not liable unless the tree was already in poor condition and thus, it fell. Civil law # 2317.1
