Today, the tree that my neighbors have neglected to cut down fell on my car. They claim that by law, they aren't responsible and don't have to pay for it. FML

Don't think they are liable, actually, unless the tree was rotting or otherwise compromised. We dropped a tree on our neighbor's car/house a few years back, and their insurance paid it all, even getting it off our property. But our tree was healthy. If it was rotting, they probably could've claimed negligence, but maybe not. This is why you have insurance, right? IANAL

Just because they claim that doesn't make it so. If their tree was overhanging your property enough to fall on your car then I'm pretty sure they'll have to pay up. If not, there's insurance. If you're not insured, then ydi.

You should plant a palm tree and have it smash their house. That'll show 'em.

If it's healthy and totally unforeseeable that it would drop, then probably no hope. If it's dead or top-heavy, as in it wasn't properly trimmed, try something called the rule in rylands v fletcher (Basically if you keep something 'dangerous' on your land and it escapes, you're liable for damage that is causes). It's a UK case though; not sure what the US incarnation of that case is or if its even applicable in the US.
