Today, the tree that my neighbors have neglected to cut down fell on my car. They claim that by law, they aren't responsible and don't have to pay for it. FML

if the tree was on their property yes it is their legal responsibility to pay for the damage to ur property (aka ur car) go to court, may the best lay degree win. personally I hope u kick their ass

if it's on their land it's their tree and therefore their responsibility if it falls on anything

Your neighbors are certainly free to use that defense when they are sued in Civil court.

It happened here in VA, except the tree fell on a house and by law, the owners were not responsible! I think it's different everywhere, you should call your insurance or a lawyer! Good luck! It sucks for you!

Technically, you're right. If the tree was on their property when it fell, it's their fault for the damage it caused. This means that they are legally responsible for the damage to your car, and have to pay for it to be fixed.
