Your neighbors are certainly free to use that defense when they are sued in Civil court.
It happened here in VA, except the tree fell on a house and by law, the owners were not responsible! I think it's different everywhere, you should call your insurance or a lawyer! Good luck! It sucks for you!

Technically, you're right. If the tree was on their property when it fell, it's their fault for the damage it caused. This means that they are legally responsible for the damage to your car, and have to pay for it to be fixed.
