If you were so worried abot this tree that you were asking them to cut it down repeatedly. Then why did you park in such a way that your car could be crushed.
Maybe he doesn't have a very big driveway and it's the only place he can park his car? :/ What is OP supposed to do... Park on the road?
I'm currently in law school and in my torts class we recently learned about the duties of owners/occupiers to people off their land. Assuming that the tree was on their land they are likely liable to you. In the majority of states owners' of land have no duty to people off their land but the one exception is in the case of trees falling onto adjoining land and physically damaging people or property. It sounds to me like your car being crushed would fall under this one exception in tort law so if I were you I would consult and attorney about this. I'm not sure of your jurisdiction so I can't be one hundred percent certain that your courts observe this exception, but it is the majority approach in the United States.
