It could be that her parents owns or pays for her apartment or wherever it is that she lives and they told her he's moving in. if she said no they might have her move back home or something. Or maybe she loves her brother and though she doesn't want to live with him she won't just kick him out because that could hurt their relationship.
I'd be more concerned with how the hell he got in jail.
