Who's fault is that?

Today, I failed my driving test. Why? Before I even began driving, someone hit my car while it was still parked. FML

I understand if the other driver had lost his driver's license for a while because of this, but why did this result in you failing the test?

I don't know where OP is from, but I know in Australia (NSW at least) is an automatic failure if there's any collision. I failed my first attempt because someone rear-ended me at a stop sign. It's a stupid rule in some cases- there was literally nothing I could have done to have avoided someone else's mistake. Sounds like OP is in the same boat

Was it legally parked in a parking area?

Considering they were about to take a driving test? Dollars to Doughnuts they were, otherwise they wouldn't have had to wait for a car to hit them, they'd have failed before the instructor even sat down.

You obviously have still not grasped the fundamentals of Defensive Driving. You need to be prepared to avoid every possible asshole driver! You should have pulled out of their way.

now this makes me think it was 100% correct failing you, as the reason you list is not a reason to fail. You did something wrong and seems to not even have realized what. Now, THAT is scary and why failing you seems like the 100 % correct solution
