Stuck

Today, I was feeling down about being stuck in bed after ankle surgery. I thought I would go ahead and call my boss and let him know everything went well. He said the obligatory nice things, then told me that if I'm not at work on Monday, I'll be fired. I can't even get out of bed. FML

Hopefully he's joking. If not, sue for unfair dismissal.

That's illegal. Employers have to give you leave for things like surgery. There's a federal act that mandates it called FMLA. If he attempts to fire you over this, you can definitely get him in a lot of trouble.

He should try and fire you. And then enjoy getting fired over wrongful dismissal.

As several people have pointed out, this is against the law. Call him up and point this out to him before you do anything else.

As several other people have pointed out, the "law" has a large number of loopholes. YMMV

Gotta love a boss who thinks that he has his own laws and rules to follow, none of which are indeed the actual law. The fun part is when those lawsuits and the dismissal notice from their boss show up on their desk, leaving them speechless.

As people have pointed out the obvious, this is unfair. Report this right away! Then munch on popcorn as your jerk boss gets fired.

They can't fire you for Medical problems if they do you can sue. Lots of lawyers will be willing to take the case too. You have to also have a work release from you Dr. first.

Get a wheelchair. The FMLA doesn't apply to small companies and in other cases. Although it may be a dick move by the boss, he may be within his legal rights to can the OP. Maybe you can get one of those cool electric jobbies that fat and/or handicapped and/or lazy people plow through Wal*Mart in. Load up on Oxycontin before you attempt to operate one at work.

If your ankle wasn't so bad you should kick him in the balls.

I'd give fair warning and if he still said he fire you sue and get him fired or go with the wheelchair and when you see him run over his foot and innocently apologize all the while knowing he can't do anything since you are at work
