Yeah, you can probably get out of it easily. If the cop didn't pull you over for talking on the phone and only came over after you pulled over and were off the phone, then he can't prove that you actually drove while talking. You can lie and say your phone rang, you pulled over and found out and stayed pulled over because you were upset. Even though that's not the case, the judge doesn't know that, and the cop never saw you on the phone, so neither does he. So sorry for your loss though...

...if your friends died because their car got hit by somebody talking on a cell phone, this would be hilarious. and to everybody saying that it's not a big deal to talk on a phone while driving: according to a study done by the university of utah, talking on a cell phone while driving can be as dangerous (if not more) as drunk driving. So would we still be calling the cop a dick if he gave a ticket to the OP if she were drunk, with the same circumstances?

lmao!!! I was thinking the exact same thing.. Who worries about something so insignificant at a time like that?? The last time someone close to me died my world temporarily stopped and I can't tell you anything else that happened other than them dying.. yea, yeah, yeah so it didnt happen today bc fmls all start that way.. but if it were me the last thing i would remember about that day would be the stupid ticket.

The no cell phone while driving law is completely ridiculous. Shitty drivers will be shitty drivers if there on the phone or not. Being on the phone just gives them an excuse.
