it is actually binding in my state at least- if she cheats she has to give it back- if he does she can do whatever she wants with it- if you can prove it of course... but yes. It is a contract to get married, at least in some states
Its considered a contract in my state as well. Here though unless its given on her birthday, Christmas or Valentines Day, therefore making it a gift, the woman has to return it to the man. Even if he's at fault or is the one to call it off.
