Couldn't have been "out of nowhere" because you were somewhere...the park, & unless you're swinging improperly or someone runs in the way of you swinging or you purposely swing with your eyes shut...I can't see how you could hear a thud out of nowhere & accidentally kick another person in the head. It usually happens when you're being irresponsible in using the swing properly.(been there, done that...also been the recipient as well)
Then you obviously were not paying attention if you got hit by someone using the swings. There is also the possibility that the kid was behind him which would explain why the OP didn't see the kid. It's the kids fault for not paying attention.
35, you might have liked getting hurt on the playground on the 70's, I however didn't....but I did "suck it up" laugh and continue after every time I got hurt...I agree that there really wasn't any "safety" crap back then...if you couldn't take it, you didn't belong on the playground. Thumbs up for 70's safe-less playgrounds...whoo hoo!

Ah well, if he's a special needs child, someone should've been with him to make sure that didn't happen. It wasn't your fault. Don't listen to these jerks who say it was or call you names. He should've been smart enough not to go near moving swings. I knew and still do.
I think that happpened to me once.. I would just apologize and if they treat you like you're some kind of criminal.. You just tell them to think what they want but THE ONE RESPONSIBLE for the child is the PaRENT so its their fault.. Saying sorry is just to be nice you know? Cuz i mean it must have hurt but its not your fault
Nice job. How about you open your big bleary eyes and be aware of whats going on next time you take your whirlwind of destruction to the park? Little kids act like little kids. It is up to others, even older children (I think you qualify), to be responsible for them.
er..... no. If I was in a park, I would not be responsible for other peoples stupid kids. If you have a kid, it's YOUR responsibility to keep it safe, not mine. I'm all for kicking other peoples kids if they wander in front of the swing I'm on (while it's moving). The parent should just be more attentive and these things wouldn't happen.
