Mate, the police can only go on the face value of the problem, they don't actually charge you with the offense, the prefer it to a magistrate who has the final say in the matter.

Sorry op! Unfortunately, you're always liable for hitting a pedestrian. At least you won't be financially liable though.

Wellllll technically you did "hit a pedestrian"...but I would hope the dumb ass cop would show some common sense discretion and not ticket you given the circumstances!!
Given the fact there actually was an accident, he has no choice in the matter. Emergency services and insurance companies are already involved, so he could really lose his job if he didn't report it.
this is scary. a lot of people supporting a dude who hit an old man walking in the middle of the road. 1: the driver must be blind, not seeing an person in the middle of the road 2: the driver must be pure crazy to disput the charge, after all he hit a soft target. 3: people on this site must be psychopats supporting the driver actions. SCARY
No.. What's really scary is that so many Other people on here cannot see the obvious fact about driving, aka that there are literally dozens of situations that could prevent the driver from stopping in time to prevent hitting the man, safely or otherwise. I'm not sure how long you've been driving, Sir, but I haven't been driving for even a year yet and I already realize this fact perfectly.
@71: You weren't there. This person admitted to waiting for someone to hit him just so he could claim it, and you are still supporting him? Since you weren't there, you have no idea of how visible the man was. I know plenty situations where you can easily miss someone walking on the road. Driver didn't do anything wrong, accidents happen. In fact, I think you're the psychopath, supporting someone who was deliberately trying to cause an accident.
guess you saw the whole thing? op said the elderly man confessed to walk in the middle of the road, not jumping infront of his car, not running over the road, but walking in the middle of the road. If you as a driver is to stupid to stop or even change lanes to avoiding hitting this person, then you dont deserve a licence.
Those of you who are blaming OP are being way too hard on him. Accidents can happen at any time, regardless if whether or not you're paying attention. I myself almost had one at a stop light. I was waiting to turn left, and I was at a light where anyone taking a left turn had to yield to those who were going straight across. I was paying attention and noticed that the light had turned green, but the person across from me who was planning on going straight hadn't noticed. I didn't realize that they had not noticed, and, after waiting about a minute (I had someone behind me, so I thought this was more than a reasonable enough time to wait before making this assumption), started to go because I thought that perhaps they were letting me go first. Unfortunately, they must have finally noticed the light was green and started to go at the same time, as soon as I realized that they were going, I stopped, but the bugger still glared at me the whole time as they drove by, as if it was my fault that they had failed to notice the light had changed to green. Plus, I had my blinker on the entire time, so it wasn't as my intentions weren't clear. Perhaps they had noticed my movement and just started to go without thinking. I will admit that I could have waited longer, but it is very hard to judge these things, especially since I am a new driver. However, whether you're a new driver or an experienced one, accidents are very hard to avoid because you cannot predict other humans. It's just not possible to predict them, and it can be very difficult to stop a vehicle in time due to how much they weigh.

Depends on where you live. Over here pedestrians are protected by law. Regardless of the situation, if you hit a pedestrian it is always your fault by law. They could be hiding naked in the bushes, waiting for you to pass you and then jump in front of your car, still your fault... Has something to do with them being extra vulnerable in traffic...
