It is totally legal, at least here in NY, and I'm sorry to say but that's points on your license if I remember my driver's ed correctly. I think 1-9 over is one point, and then it goes up like that. That means higher insurance, and if you hit eleven you're out of a license. That said, I would still try to fight it. One mile over, I doubt they'll keep it.
Well I'm probably going to get loads of people yrlling at me for saying this but ah well should be said anyway. If they didnt count one mile over the limit then the boundaries of road rules will be stretched people will think 'The wont mind if its 31mph why not 32' and so on until everyone is going 10 mph over the limit on a regular basis. Most people who start off poking people will end up strangling them until the boundaries are set, so its best to set them up early (a kind of comparative metophoar for you). P.S. I forgot how to spell metphoar properly.
Subpoena the officer for his radar/laser training and radar/laser calibration. if he's pacing, then get his speedometer calibration. If he's doing it by eyes, it's even easier to prove that eyes can't even perceive speed off by 1mph. Get a few video clips of a baseball and ask him to estimate the speed in mph.
when you fight it in court tell the judge there was personal bias involved, and ask for a printout the radar gun. Never mention the relationship unless the judge asks other than you know the cop.
Take it to court. He won't show.
To all you less intelligent people, there is law that you cannot be ticketed for anything less then 5 mph over the limit. All cars speedometers are faulty and innaccurate. I know on my dodge, the speedo reads 1 mph fast, the chevy malibu 3 mph fast, the honda 4mph fast. Automakers make the speedometer read incorrectly and fast because it causes the odometer to rack up miles so much faster, hence the warranty expires sooners. Go figure Honda gives you a 100,000 mile warranty, it will expire fast. They even got sued over the subject. I can only imagine how far off a Kia speedometer is.
It is legal (no matter what any other person trying to pretend like they're smarter then the rest of us say) but if you go to court 99.9% of the time the judge WILL throw it out (unless you also happened to date and break the daughter of the judges' heart lol)
