It seems as though your instructor is an idiot and sucks at his job.
You definitely need to report that instructor. Some of them stick to the book to such an extent that they're unable to reward good action. You did well, OP, if only more drivers like you were able to pay attention to their surroundings we'd be in a better place.
That's what I'm thinking. Even if he can't challenge the instructor's decision he should report what happened to the DMV. They might not do anything, but at least it will be on record if anything like this happens in the future.
Similar thing happened to me, but luckily it wasn't a test but a regular lesson. "Why are you slowing down?? Don't you know you have the right of way?!" - I know, but he obviously doesn't.
They fail you for anything where I'm from cause it's run by a private company. You have to repay the same company to redo it.
Where I'm from, you don't have to pay anything for your driving test unless you pass. Then you pay for the license itself. The DMV here isn't a private company. (:
Here it's around 30$, so yeah, having to pay 2, 3, or more times can get pretty expensive, and if they're basically failing you for the fun of it then you're just throwing away money for no reason. I would refuse to retake the test unless they could give me a valid reason- something I actually did wrong- for the failing mark.
Is that all it is?? Over in the UK each test is £62, you pay that regardless of the result, plus the cost of hiring the instructors car for two hours (unless you have your own) which normally costs around £40!!
That's just the test, mind! You also have to pay for the provisional license which is £50! You're lucky!!
'Murica ...
Your instructor is an idiot.

And this is when you report him and say "you failed, at keeping a job"
You did the right thing.
