To all, thanks for your concern. Don't worry, I'm fine, it was just a bad concussion when I hit the ground that knocked me out. I hope I don't disappoint anybody, but I am not going to sue. A few years in jail ought to be enough for the driver- it was a drunk. Luckily, there was a black and white across the street and got the driver in time. Again, thank you all for your concerns.

Mannnn, I get that shit all the time (Never been hospitalized though). Drivers just don't give a shit about runners....
i almost got run over by a taxi cab when I crashed my bike yesterday...that really sucks man.
Sue him for sure.
that is my BIGGEST fear when someone waves me on to cross the road!
I hope his/her insurance pays for that. I have 'sort of' been on both sides. A) My friend M.S. truely hit a jogger by accident when she was 16-17. In the courtroom, it turned out it was the jogger's fault anyway (due to the fact Jogger was jogging IN THE ROAD and not dressed right compared to speed limit etc.) That says something if a teenage driver gets away with that (it says jogger is a douche-bag in this situation). Later, douche-bag, I mean, Jogger, SUED M.S. JUST as M.S. was psychologically begining to forgive him/her self. It made me want to punch Jogger in the face. Repeatedly. Jogger disgusts me to this day. Fortunately, M.S. was NOT cited for anything and Jogger is paying HIM/HER. Good. Justice was done. B) When we were 5, my twin brother was hit and killed by a pickup truck. We were playing in a parking lot next to our house, our mom was watching us and holding our baby sister. Mom was on the front porch (no negligence here at all). We saw an ice-cream-man on a bike/ice-cream-thingie. We ran across the street. At this point, Mom was running w baby-sister toward us. We did not have cash. We ran back across the street, I made it across and Brother didn't. We were at fault, truck driver was not. He came back a week later and apologized and said he did not go to the funeral b/c he felt too bad about it. He should not have felt bad, I do. Had I not tried to race Brother, he would not have diede. Simple as that. It was my fault and no one else's. Anyway, from this situation, it sounds like driver made a bad mistake. it is possible they accidentally hit the gas. Even so, driver should pay for any injuries you have NOW and any problems you will have in the future. It is the only way Driver will learn. On your end, I would spend the $ you get from driver by going to this thing called a GYM or the YMCA/YWCA where you will not get run over when you are out exercising.
