A used condom should be considered just as toxic as household cleaners or medications. If OP said that their baby pulled out a canister of Comet and was playing in it, everyone would be freaking out that it was OP's fault for leaving it where the children can get to it. It is true that children get into things, and that parents don't often have a lot of control, but some things have to be put away and locked up tight enough that a child can not get to it.
Toxic? Condoms aren't toxic. Well, not in a normal way. The rubber isn't toxic, but if you're talking about how the stuff INSIDE the condom, well, it's not toxic but potentially harmful so I see where you're going with saying you should treat them the same. I understand your point and agree with you though. They're dangerous for children, it's a choking hazard, and if it's not OP's, just some random condom then it could have all sorts of nasties on it. Condoms should be wrapped and placed into the bin out of the way, and if it's not OP's condom, then how was the kid wandering around somewhere alone where they could pick up a condom? I know you can't watch children all the time, but a child that small can't get far from you and needs a LOT of watching to be sure things like this don't happen.
It's probably not the parent's. I found a used condom in the bushes in my school playground back in grade 6.
