Today, my lawyer threatened to sue me because I can't afford his bill, which he sent to me after getting me out of a lawsuit. FML

I've worked for lawyers, and I cant even begin to tell you how many people think they don't need to pay their bill. Its not like they surprise you with how much it is going to cost. Most of them tell you upfront approximately how much it will cost. This is what they do for their living. If you don't pay they don't eat! Yes some are unfair but a lot of them actually do more work then they charge for and often give people breaks when they know they cant afford a lot and they just turn around and dont pay anyway. Its not fair. Suck it up, Pay your bill, and if you have a hard time affording it, work out a payment plan. Don't be a douchebag and expect not to pay anything after you have used his services.

Except it would be more like, the employee made the sub, you ate it, you couldn't afford it though you were well aware of the price, and then went on FML when he demanded you pay for the sub or he calls the cops.

The Legal Profession is the only one in which the clients uniformly believe they don't actually have to pay for services performed.

almost any civil lawyer would go for damages+legal fees. so either fake, or you're a ******* retard for hiring an idiot.

That's only plaintiff's lawyers. OP was being defended. His lawyer kept him from having to pay the other guy. And that's why the first thing every lawyer tells a law student is to get paid up front.

#26 - you can't always get legal fees. Also, OP said his lawyer got him OUT of a lawsuit, which means he was the defendant. The person suing can sue for legal fees, but the person being sued can't say "you didn't win, now pay my lawyer."

Gsfgf and perstephane-- actually, depending on the facts of the case and/or state statutes, EITHER party's attorney's fees may be paid by the other side. So yes, even a plaintiff may be required to pay defense counsel.

The problem with fee-shifting tort reform is that the lawmakers leave it up to the judge to determine when it applies. Look at FRCP 68. It's there, but it's almost never used, as nice as that would be. What would be required is a British style of fee structure, but then you run into the problem of the overly optimistic client.

The poker rule is almost never used? No way. Any attorney worth his salt is going to utilize that. And the rule and its corresponding statute leave no discretion to the judge. The parties either comply with the procedure or they don't, and depending on where the judgment falls, they either get fees or they don't. I think FRCP 68 actually echos the theory of the British system by promoting out-of-court settlement.

hmmm... sucks that you don't have money to be sued for and don't have money to defend yourself. there has to be more to this story. u can't be this dumb.
