Just because you are renting does not mean the landlord has to allow you to have anything you want. If it says, "no pets allowed" that means no pets. And a fish is a pet. Depending on how big the bowl/aquarium for the fish is, the water could potentially cause damage. I am sorry to say that since you do not own the property you really don't get to do as you like.

What does your lease say? If it says "no pets," you're screwed. If it says, "no cars or dogs," you can and should sue.
Actually, they cannot evict you. If its a material breach of the lease, you are given time to correct the situation. My ex husband snuck a cat into our apartment in Alberta and we were issues a notice to remove the cat or would receive eviction notice. My current landlord asked for a pet deposit of $600 for my son's hamster :(
It would be the same for a cat or small dog. Plus rodents (especially those owned by children) can get lose and cause damage like eating wires in the wall or having other baby hamsters. No one wants your son's hamster in their apartment when it escapes. Just because your pet is small does not mean you get special treatment.
