Today, I got my hair dyed at a fancy salon. While the stylist was pulling out the foils in my hair I sat up and started screaming in pain because the hot foils were burning my scalp. All she said was "oh, you're fine". I went back home to find an oozing burn wound on my scalp. FML

Were the foils actually hot or was it the chemicals they were using that burnt your scalp? This happened to me once when I got my hair straightened. They left the treatment on for too long and I ended up with a very sore scalp and red burn marks on the top of my forehead. Needless to say I didn't go back there again.

#12 & 30 - I think #10's comment was more about the misspelling of cosmetology as cosmOtology. Regardless, If you said it was causing pain, the colorist ignored you, and now you have a physical injury, you should *at the very least* get a full refund. If they refuse to make any sort of restitution, then I'd consider suing. The colorist's behavior was definitely negligent. I've gotten my hair dyed many times and have never gotten any type of burn...or any pain at all. Something wasn't right with this.

#26, as a law student, you should also know that the costs of pursuing this case would far, FAR outweigh any settlement you could possibly hope for. Suing is a no go. And you seriously screamed?

Hey, I just wanted to let you know that when my cousin went to the hair salon, they burnt her head, but told her not to worry about it, she had 3rd degree burns, and she sued the salon. You can sue if you like, its phsyical damage.

FYL. And definitely sue. This is exactly the kind of thing that the civil courts were intended to address. As far as the legal costs, those can be included in the settlement - why should the injured party have to pay to have the wrong be righted?

I would definitely sue if I were you. You'll definitely win. I hate when beauticians claim "you're fine" or "it's just the so-and-so" (grease, oil, or w/e hair product).
