Yes, she was dumb for slamming on her brakes, but you were tailgating because there is no need to rear-end someone unless they swreve infront of you and slam on their brakes without a warning. It is possible to not get in accident because people generally do not want to get in accidents. However, if they do, then you can get into an accident.
ehh..that could kinda go either way. I mean, you must have been too close or not paying attention, or SOMETHING..if you SLAMMED on your brakes, you should have had enough room/time to stop if you were a good distance away.. Butttt, at the same time, shit happens. I alot of the time get on people's asses..I mean, who doesn't? But...that sure is a good reason not to!!
#5 has it right. In some countries, large vehicles are actually charged with Attempt of Murder and thrown into jail if they drive to close (not nessesary just tailgating, but simply being too close for not being able to stop in time). Those are however such vehicles that would pose no injury to the driver if they were to crash into someone - like an eightwheeler.

Sucks, but if you didn't leave enough space for adequate reaction time, you WERE tailgating. Same would've happened if a deer darted out into the road and she slammed on her brakes. Shame he didn't take into account the fact that she'd needlessly slammed on her brakes and cited her for that as well, but you were totally in the wrong here too. Best practice is to leave at least four seconds between your car and the car in front of you, and ten seconds in the rain. If you can't react to the unexpected because you're following too close, it is in fact your fault.
At LEAST 2 seconds between you and the car in front. And how can people say this was in any way the cop's fault?
I hate people who slam on their brakes just as much as you or any other person but if you hit her than that means that either a) you have really really slow reflexes or b) you where tailgating her.

if u were close enough to hit her when she slammed on the brakes, YOU WERE TAILGATING HER it's not the cop's fault and no the lady didn't have to freak out and slam on the brakes, but the whole point of leaving distance between cars is to allow enough room for the person in front of you to stop suddenly and without warning.

Thats the technical definition of tailgating. If you're so close to the other car that in a situation in which the car in front of you suddenly breaks, and you rear end the car in front of you, that would be tailgating. Really, what do you think tailgating is if its not exactly the situation you're in now?
I cant stand people who slam on their brakes whenever they see a cop. Especially when the dudes on the other side of the highway
